Terms of Service

YOU AGREE THAT YOU ARE OVER THE AGE OF 18 AND ARE OTHERWISE CAPABLE OF ENTERING INTO A LEGAL CONTRACT

1. You have to be at least 18 to commission me (yes, even for SFW).
2. Prices are for non-commercial use.
3. When purchasing a digital commission, you acknowledge that you are receiving nonexclusive rights and a digital, non-physical file
4. You can post your commission online as long as you credit me properly.
5. Be respectful throughout the commission process.

Please do not hesitate to email me or fill out a commission form if you want a quote, or want to make sure I can/will draw what you have in mind. It is ok to fill out a commission form if you just want a quote and are not sure you will be going through with a commission.

FINE PRINT:

1. OUR RELATIONSHIP
You, the commissioner, are commissioning me, Rosy, as an independent professional to create an original work of art. I am free to provide my services to others during completion of your Service. At the completion of this Service you will be granted a license to use the Final Work. You are not purchasing a physical or digital good.

2. PRICES
All listed prices l are in American dollars (USD) and are considered to be "base" and non-negotiable—your cost may be higher depending on the scope of this Service and any potential complexity fees. After I receive your commission form I will email or DM you a quote with the cost of this Service. This cost is negotiable if you have incurred complexity fees. Payment means that you agree with the cost of Service.

3. PAYMENT
After filling out the commission form, if I have accepted your commission you will be e-mailed or DM'd a quote and I will invoice you for 50% of the commission fee through Paypal. PLEASE WAIT FOR THE INVOICE. Payments received outside of these invoices will be treated as a tip.

I will complete a sketch of your commission after your 50% deposit invoice has been paid. I will send you this sketch via your preferred contact method. This sketch can be approved as-is or modified for no additional fee. Once the sketch has been approved, I will invoice you for the remaining 50% of the commission fee.

I will complete the commission once this second invoice has been paid and send you a digital file of the artwork.

4. REFUNDS AND CANCELLATIONS
If you need to cancel this Service, I can accommodate for refunds
You will allow me one to four weeks to process any refunds, and will be refunded according to this structure:
a. If work has not begun, you will be fully refunded for your initial 50% deposit.
b. If the Sketch has not been approved, you will be refunded your initial 50% deposit minus a sketch fee of 20% of your quoted commission price.
c. If the Sketch has been approved and work is still ongoing, you will receive a 20%-50% refund depending on the degree of work completed.
d. Upon Finalization, no refunds will be issued.
If you breach these Terms at any point, the Service will be canceled and you will not be refunded. I reserve the right to cancel this Service for any other reason, including none, and in this case, you will be refunded fully, regardless of progress.

5. REVISIONS
PLEASE DON'T HESITATE TO POINT OUT ANY MISTAKES. If I make mistakes during this Service (which conflict information provided via email or in the commission form) I will make any changes necessary to correct them with no additional charge.
Prior to the Sketch being approved I will make an unlimited number of changes to the Sketch within the Scope of this Service. If the Sketch has been approved, revision requests that would require changes to the Sketch will be subject to a revision fee. This fee will be no less than $10 but may be more depending on the request. I have the right to refuse any requests that would significantly alter the Scope of this Service, especially if you refuse the revision fee.

6. FINALIZATION AND DELIVERY
During this Service you will be given opportunities to approve WIPs, agreeing that what is approved will be roughly as it appears in the Final Work. By approving a WIP, you also agree that it's free of mistakes and that I can progress with the work. When you have approved a WIP that meets the Scope of this Service, the Final Work will be made and this Service has been Finalized. I will then send the completed work to you to download via your preferred contact method (twitter or email) At that point the licensed rights will be granted to you.

7. GRANT OF RIGHTS
With regards to the Final Work created during use of this Service I grant you a PERPETUAL, NON-EXCLUSIVE, NON-COMMERCIAL license to: upload to FREELY AVAILABLE online services with artist credit; to MODIFY (excluding modifications that would remove my attributions/watermarks or harm the integrity of my art/business) or CREATE DERIVATIVE WORKS THEREOF; and to COPY, DISPLAY or DISTRIBUTE the Final Work in print. I grant you the right to sub-license these rights, in whole or in part, to others. You do NOT have permissions to create NFT's of these works.
I will not sell the Final Work. I retain ownership and authorship of all works I produce. I retain full rights over all materials created.
In any event of refund or cancellation, ownership of all rights granted to you under this term will revert back to me, and vice versa. Any grant of rights is contingent on payment in full and Finalization of this Service. You agree that a chargeback or reversal of payment will constitute a breach of these terms, and that this grant of rights will be revoked if you do so.
You and I reserve all other rights not expressed in these Terms.

8. SURVIVAL
All terms that would logically survive the cancellation of this agreement will survive termination. These explicitly include the Refunds, Confidentially, Arbitration, Jurisdiction, Severability, Warranties, and Force Majeure clauses. As previously noted: in any event of cancellation, ownership of all rights granted to you under these Terms, specifically clause 7 ("Grant of Rights") will revert back to me, and vice versa.

9. CONFIDENTIALITY
You and I both agree that we will not knowingly share any private information gained during use of this Service. The exception to this is any disclosure required to complete the Service. Private information is:
a. Any names, e-mail addresses, physical addresses, dates of birth, or other information that could reasonably be deemed personally identifiable.
b. Any information relating to my business that is not made readily available and public, including the cost of this Service.
c. Any account information, including but not limited to Skype, Facebook, Paypal, bank accounts, or otherwise.
